In Emma's Miller Application she names her father and mother as: James Hood and Lydia Hood. Mother's maiden name is listed as Lydia Burns. Emma states on line # 7: By what right do you claim to share? If you claim through more than one relative living in 1851, set forth each claim separately:
For my sisters: Mary and Nannie Chamber, My Father: James Hood. My uncles Richard, Tillman, Ellis and John Hood.

Emma states her brothers and sisters as:

On line 21 of her Miller's application, she states: My grandfather Sunday Downing, Lived in Cherokee Nation, east in 1835.

Emma's sister, Elizabeth, received a letter from the Commisioner regarding her father, grandfather, etc. Emma made the following deposition and it is attached to Elizabeth's Miller's Application:
Subscribed and sworn to before me at Porum, Okla. this 24 day of Mar. 1909: H. C. Black; Asst. to the Special Commissioner of the U. S. Court of Claims

"Emma Filmore being first duly sworn deposes and says that I was born in 1851. My fathers name was James Hood. He had two full brothers by the name of Dick and Tillman Hood. I do not know who my grant father was but I have been told that his name was Sunday Downing. EMMIT STARR told me that my grand fathers name was SUNDAY DOWNING. My grand mother and my mother were white women. My father had a half brother by the name of John Hood. He was enrolled as an Old Settler. He had no children and I drew his old settler money in 1894. I was told that my father was living in Can. district, but that he was enrolled in Seqyoyah in 1851. My father raised his brother Dick. I do not know where he was enrolled. My father went by the name of his mothers second husband, who was the father of John Hood, the old settler. See S. B. #61? Will this group with 10793?"
