SALE! of Real Estate.

By virtue of an order of the County Court of St. Charles County made on the 29th day of November last, I the undersigned administrator will on Tuesday, the 26th day of February next, between the hours of 9 o'clock, in the forenoon, and five o'clock in the afternoon, of said day whilst the County Court of said County shall be in session, sell to the highest and best bidder, on a credit of nine months, the purchaser giving bond with approved security, all the right title and interest, held in and to the following describe Real Estate, by JOSIAH W. TARBULL, dec'd., at the time of his death, or so much there-of as may be necessary to pay the debts of said deceased. Viz:
The North West 1-4 of the South East quarter of section No 17, township No. 47, of Range No. 1, east containing 40 acres.---Also, the south west quarter, of the south east quarter of section NO. 17, Township, No. 47, Range No. 1, East containing forty acres.

Know all men by these presents that I John Smith administrator of Josiah W. Tarbell deceased am held and firmly bound to Henry Yost in the final sum of six hundred dollars the payment whereof will and truly to made I hereby bind myself and my successors.
The conditions of the foregoing obligation is such that whereas the above bound John Smith administrator as aforesaid has sold to the above named Henry Yost the land belonging to the estate of the said Josiah W. Tarbell deceased consisting of eighty acres of land it being the west half of the south east quarter of section 17 in Township 47 and range one east of the fifth principal in on side an for the sum of three hundred dollars for a portion of which purchase money the said Yost is allowed a credit until the first day of December ninth Now if the above land(land?) John smith administrator as aforesaid shall make a good and bonfide warranty deed to the said yost to the above described land on the payment of the full amount of said purchase money then this obligation to be void otherwise to remain in full force given under my hand and seal this 19th day of January 1849

The following copies of receipts were obtained in July 1997 from "The St. Charles Historical Society"
I Mary E. Tarbell widow of the late Josiah W. Tarbell of the County of St. Charles and state of Missouri do hereby renounce and abrogate my legal rights to a preference in the administration of the estate of my said deceased husband and do recommend to the Court my father John Smith for that appointment given under my hand this 28th day of February 1848
