Filed September 12, 1857 - The State of Alabama, Monroe County
This indenture made the 16th day of May one thousand eight hundred and fifty seven, between Whitman COTTON of the County of Monroe & State of Alabama of the first part and A.P. COTTON and R. HINES of the saim County & State of the second part. Witnesseth that the said party of the first part in consideration of the sum of forty five Dollars lawful money of the United States to him duly paid has sold and by these presents does grant and convey to the siad party of the second part all the cotton crop that he may or does make in the year of 1857. The Grant is intended as a security for the payment of a forty five Dollar note made payable to Hugh MCKENZIE, due first day of January 1858--as signed Whitman COTTON, A. P. COTTON and R. HINES-- which payment if duly made by Whitman COTTON on or before that time will render this conveyance void-- and if default shall be made in the payment of said not interest and cost if any they the said partys of the second part on thus assigned are hereby autherized to sell the cotton above granted or so much there of as will be necessary to satisfy the amount then due with costs and expenses allowed by law.
In witness where of, I have hereunto set my hand and Seal, this the 20th day of August A. D. 1857.
