Charles County Land Record Book G#3, 1756-1761; Page 359. Lease. Mar 28, 1759 from James Edelen of Prince Georges County, Gentleman, to Nathaniel Holley (Halley) of CC, planter, the lease of all those parts of tracts of lands called Hopewell, Smallwoods Meader, and Friendship, being all the lands the sd James Edelen purchased of William Smallwood, lying in CC, containing and laid out for about 90 acres. To have and to hold to sd Nathaniel Halley from today during three natural lives, viz, the life of the afd Nathaniel Holley, Mary Halley, his wife, and William Halley, their son, paying yearly to sd James Edelen a rent of 950 lbs of crop tobacco in cask on each May 10. If the rent is 19 days late, and no sufficient distress upon the premises can be found whereby the same may be levied, then sd Edelen may reenter and have again the sd demised messuage and premises. If Mary or William Halley die in the lifetime of sd Edelen, Edelen will execute another lease for three lives. Nathaniel Halley, within 3 years, will plant 100 apple trees. Nathaniel Halley will not cut or sell any timber more than for the use of the plantation, and not to have any under tenant without the consent of sd Edelen. Signed - James Edelen. Mar. 15, 1774 - Prince Georges County, Md. Land Records. The following deposition was given at a land commission for "Charley" owned by Thomas Hanson Marshall. The deposition was taken by the commissioners at the land, being on the south side of a road that leads out of Pomonkey Neck to Piscataway, between plantation of Mrs. Elizabeth Beall's and Susanna Dyar's and near to John Emmerson Jr.'s fence.
Nathaniel Halley, aged 44 years or thereabouts [so b. ca. 1730], declares that about 20 years ago or thereabouts Malcom McBean showed me a tree and said it was the last or corner tree of Mr. John Beall's land; the tree appeared to be about one foot or fifteen inches through; it was either a gray or red oak; sometime after, he this deponent saw some persons surveying and he went to them; it was Mr. Hodskins, George Parker and Edward Cole as they were running a line and stopping at the end of their number of perches, then Mr. Parker rode over for Mr. Beall; after sometime Mr. Parker and Mr. Beall came together to the place where they had stopped; then Mr. Beall took Mr. Thomas Marshall aside; after some time Mr. Parker was called to them; in a little time after they all came to the said tree, then went on surveying down into the Neck; sometime afterwards he was in company with Mr. George Parker riding to Portobacco; he this deponent asked Mr. Parker what passed between him, Mr. John Beall and Mr. Thomas Marshall about the tree; he told this deponent Mr. BeallPsi reason for not showing him the tree when he first came was he did not choose? to show him the tree till he asked Mr. Marshal/ whether it would not be of prejudice to him or not, and that Mr. Marshall said it would not then Mr. John Beall showed Mr. Parker the said tree and told him it was his last corner tree.
